How Illinois farm leases work
When a Illinois lease can end, how much notice it takes and what to put in writing.
How to end a Illinois farm lease
Year-to-year farm tenancies in Illinois, including cash rent, crop-share and livestock-share leases, need at least 4 months' written notice before the end of the lease year (735 ILCS 5/9-206). The requirement can't be waived in a verbal lease.
| Situation | Notice rule |
|---|---|
| Lease year ends Feb 28/29 (most common) | Notice by Oct 31 |
| Lease year ends Dec 31 | Notice by Aug 31 |
| Written lease with a specific end date | Ends on that date; no 4-month notice needed |
Notice can be served in person, by certified or registered mail with a return receipt, or by posting, according to University of Illinois farmdoc. If notice is late, the tenancy continues another year. Compare every state in Oaken's farm lease termination guide.

Oral vs. written leases in Illinois
Oral farm leases are common in Illinois and are year-to-year tenancies covered by the 4-month notice rule. Under Illinois's statute of frauds, a lease longer than one year generally must be in writing to be enforced.
Our advice: a lease that has rolled over for years on a handshake leaves no record of the rent, input splits or notice terms. Write it down, even for a one-year deal. Get the templates →

Illinois farm lease questions
What is the deadline to terminate a farm lease in Illinois?
Under 735 ILCS 5/9-206, a year-to-year farm tenancy needs written notice at least 4 months before the end of the lease year. For the common lease year ending February 28 or 29, notice must be given by October 31. For a lease year ending December 31, the deadline is August 31.
Does a written Illinois farm lease with an end date need notice?
No. University of Illinois Extension notes that a written lease with a specific end date negates the 4-month notice requirement, and the lease ends on that date. Oral leases and written leases with no end date need 4 months' notice.
How should termination notice be served in Illinois?
The University of Illinois farmdoc team lists personal delivery, certified or registered mail with a return receipt, and posting as service methods. Certified mail with a return receipt gives the clearest proof of the date.
What is the average farmland cash rent in Illinois in 2026?
Across the 86 of 102 Illinois counties with published 2026 USDA NASS cash rent data, the median county rent for non-irrigated cropland is $254 per acre. Oaken's Illinois cash rent map shows every published county, its rank and its change from 2025.
How does Oaken help manage Illinois farmland leases?
Oaken keeps every Illinois lease, landowner and payment in one place. It tracks rent due dates and each lease's notice deadline, calculates flex and crop-share payments, and gives landowners a portal for statements, so nothing depends on a binder or one person's memory.
